Terms & Conditions

Thank you for participating in the Pizza Hut Pizza Lover’s Online Community! This Agreement (this “Agreement”) incorporates the ICMIB Terms & Conditions (the “ICMIB Terms”) and sets forth the terms and conditions by and between you and Pizza Hut, LLC (“Pizza Hut”) regarding your access to and participation in the Pizza Lover’s Online Community (the “Community”), which is a “Subdomain” as defined in the ICMIB Terms. By accessing or participating in the Community, you agree to this Agreement.

Pizza Hut, its parent corporation, affiliates, and subsidiaries possess and own certain information, recipes, product concepts, and materials that are proprietary and non-public (“Pizza Hut Confidential Information”) of which you may have access to or learn in connection with your participation in the Community. You agree and acknowledge that all such Pizza Hut Confidential Information is and shall remain the sole and exclusive property of Pizza Hut. You agree to use all Pizza Hut Confidential Information solely for the “Purpose” (defined as accessing and using the Community), to ensure that it is kept confidential, to take all reasonable measures to prevent unauthorized disclosure of Pizza Hut Confidential Information, and to not publish, post, distribute, disclose, or disseminate any Pizza Hut Confidential Information in any manner to any other person(s) or entity nor use any Pizza Hut Confidential Information for your purposes or for the purposes of any third party.

You may, at your sole discretion, provide “Site User Data” (as defined and used in the ICMIB Terms) to Pizza Hut in connection with the Purpose regarding the possible creation, modification, improvement, or enhancement of Pizza Hut products and order experiences. You represent and warrant that you have all rights necessary to submit the Site User Data and that the Site User Data will not include proprietary information of a third party. You hereby assign to Pizza Hut all ownership, right, title, and interest in the Site User Data. Pizza Hut may use, disclose, and exploit such Site User Data without restriction or any obligation to you. Notwithstanding the foregoing, Pizza Hut is not required to consider or implement any Site User Data.

You will indemnify, hold harmless, and defend Pizza Hut, its parent corporation, affiliates, and subsidiaries and its and their respective directors, partners, officers, employees, representatives, and agents (collectively, the “Indemnitees”) from all claims, liabilities, damages, and expenses, including reasonable attorneys' fees, which an Indemnitee may sustain as a result of any unauthorized disclosure by you. Pizza Hut will have the right to enforce this Agreement by injunctive relief and/or recovery of damages and any other remedies it may have access to under this Agreement or at law.

This Agreement shall be governed by the laws of New York. You further acknowledge that you have carefully read this Agreement and fully understand the terms and legal significance of this Agreement. This Agreement contains the entire understanding of you and Pizza Hut concerning the subject matter contained herein.
